ON DECEMBER 2ND, 2021 ASSISTANT CITY MANAGER, FRED BILL AND I ATTENDED A MONTHLY CDAC MEETING DURING THIS MEETING, WE DISCUSSED CURRENT PARK IMPROVEMENT PROJECTS THAT WERE EARMARKED BY PREVIOUS CITY COMMISSIONS.

THE COMMISSIONS ALLOCATED CDBG FUNDS TO BE USED TOWARDS THOSE SPECIFIC EARMARK PROJECTS.

THOSE PROJECTS ARE FILED AGAIN, PARK THE VILLAIN.

THIS PROJECT ENTAILS REMOVAL AND REPLACEMENT OF THE EXISTING CONCRETE SLAB AND INSTALLATION OF METAL COVERS SIMILAR TO THE PAVILION AT STOKEY PARK, LANDRUM AND KENNEDY PARK.

THE COMMISSION CREATED A SPECIFIC PROJECT AT LANDRUM PARK CONSTRUCTION OF RESTROOMS IN REGARDS TO KENNEDY PARK, NO SPECIFIC PROJECT WAS CREATED ONLY GENERAL IMPROVEMENTS.

THE OLD LIBRARY IMPROVEMENTS.

THIS PROJECT ENTAILS EXPOSING THE ORIGINAL BRICK REMOVAL OF THE DROPDOWN CEILING REHABILITATING THE ORIGINAL CEILING AND RENOVATING THE RESTROOMS. ADDITIONALLY, WE WILL PRESENT AN AGENDA ITEM FOR FUNDS FROM PREVIOUS AWARD YEARS AT THE DECEMBER 21ST MEETING.

MY NAME IS LES AND, UM, I'M HERE TO, UH, TALK ABOUT AN INCIDENT THAT HAPPENED AT THE TREE LIGHTING EVENT.

AGAIN, I DON'T WANT TO TAKE AWAY FROM A REALLY GOOD SUCCESSFUL EVENT.

UH, HOWEVER, THERE WAS AN INCIDENT THAT, UH, PRETTY MUCH LEADS ME TO BEING HERE, UH, BECAUSE THERE IS ROOM FOR IMPROVEMENT, UM, BECAUSE OF THIS INCIDENT, UH, AT THE TREE LIGHTING EVENT, WHICH WAS HELD AT THE AMPHITHEATER ON SATURDAY, DECEMBER 4TH.

UM, THERE WAS AN ISSUE REGARDING, UH, THE HANDICAP SEATING, UM, AND, UM, THERE WERE PEOPLE THAT WERE IN WALKERS AND, UH, THE WALKERS THAT HAVE THE SEATS AND WHEELS THAT WERE TRYING TO PARK ON THE MOUND, WHICH IS ON AN INCLINE.

UM, I, UH, WAS ABLE TO SEE THAT AND I ASSISTED FOR FAMILIES THAT, UH, NEEDED TO BE, UH, IN THE HANDICAP SECTION.

SO I ASSISTED FOR FAMILIES.

UM, AND, UM, THEY WERE AT, AT RISK OF EITHER LIKE, UH, PROBABLY HARMING THEMSELVES IF THEY WOULD, IF THAT ROCKER WITH WHEELS WOULD ROLL DOWNHILL.

UM, THERE WAS A MAN AND IT TAKES JUST ONE PERSON TO PRETTY MUCH RUIN EVERYTHING.

THERE WAS A MAN SITTING IN THE FRONT ROW, ALONG WITH HIS WIFE AND KIDS THAT WERE SEATED IN THE HANDICAP SECTION.

AND HE TOOK UP THE ENTIRE FRONT ROW.

UM, THEY DID HAVE ONE ELDERLY PERSON WHICH MAY HAVE BEEN THEIR FATHER, UM, IN A WHEELCHAIR.

UM, THE MEN, UM, SINCE I WAS THE ONE THAT ASSISTED THESE OTHER FAMILIES, HE CAME TO ME WHILE I WAS SEATED IN MY LAWN CHAIR WITH MY MOTHER WHO IS ALSO HANDICAPPED.

AND HE REQUESTED FOR ME TO REMOVE THESE HANDICAPPED PERSONS.

I HAD JUST ASSISTED BECAUSE HE WAS GOING TO RECORD HIS DAUGHTER'S PERFORMANCE AND HE DIDN'T WANT ANYONE BLOCKING HIS VIEW.

UM, I DECLINED TO MOVE ANYONE BECAUSE THEY WERE THEY'RE HANDICAPPED.

HE THEN PROCEEDED TO ASK AN 80 YEAR OLD WOMAN TO MOVE OUT OF HIS WAY, WHICH LED TO HIS DAUGHTER, UH, COMING TO MOVE HER, UH, THIS SHOULD NOT EVER HAPPEN TO ANY HANDICAPPED PERSONS.

MY RECOMMENDATIONS WOULD BE TO HAVE USHERS OR SOMEONE DESIGNATED TO MONITOR THE HANDICAP SECTION, UH, SUCH AS WHEN WE ATTEND VOLLEYBALL GAMES OR FOOTBALL GAMES, UH, IN THE SCHOOL DISTRICT, WE NEED BETTER SIGNAGE FOR HANDICAP FOR THE HANDICAP SECTION.

UH, THERE ALSO IS A NEED FOR A HANDICAP RAMP AS YOU EXIT THE AMPHITHEATER, WHICH IS ON THE SIDE FACING THE .

THERE IS CONCRETE THAT IS APPROXIMATELY THREE TO FIVE INCHES TALL, UM, THAT DOES NOT ALLOW FOR THE HANDICAP PERSONS TO ENTER OR EXIT THAT, UH, PAVILION THAT AMPHITHEATER, UM, AND ALSO LIGHTING AS A CONCERN AS WELL.

THESE ARE MY RECOMMENDATIONS.

AGAIN, I DON'T WANT TO TAKE AWAY FROM A GREAT EVENT.

FOR THE RECORD BEFORE YOU, YOU HAVE THE EIGHTH SUPPLEMENTAL TO ORDER 2 0 2 0 DASH ZERO FOUR.

THIS IS THE, UH, THE ORIGINAL ORDER 2 0 2 0 0 4 WAS ISSUED, UH, UH, ABOUT 18 MONTHS AGO.

UM, WE'VE BEEN EXTENDED ANYWHERE FROM FIRST SIX MONTHS, FOUR MONTHS.

WE THOUGHT THAT WE'D BE OUT OF THE PANDEMIC BY NOW.

THE MOST RECENT WILL EXPIRE WHEN THEY EXPIRED ON DECEMBER 17TH PRIOR TO OUR NEXT MEETING.

UH, WE DID, UM, UH, THE CITY COMMISSION APPROVED, UH, AN EXTENSION, THE SEVEN SUPPLEMENTAL, UH, FOR FOUR MONTHS, 120 DAYS OR APPROXIMATELY 120 DAYS.

UM, AS YOU KNOW, WE NOW HAVE A NEW VARIANT, THE ARMY CRON, SO THEREFORE WE'RE STILL DEALING WITH THE DELTA AND THEN THE ORIGINAL COVID 19 PANDEMIC ISSUE.

SO IT IS STAFF'S RECOMMENDATION THAT THE EIGHT SUPPLEMENTAL TO THIS ORDER, UH, BE APPROVED, UH, AS YOU GO THROUGH THE, UH, THE, WHEREAS YOU'LL NOTICE THE GOVERNOR'S, UH, ORDERS, CAMERON COUNTY, EDDIE, UH, EDDIE TRIVIUM ARE OUR PRESIDENT'S ORDERS THAT ARE ALL STILL IN EFFECT.

I DID GO BACK AND I, AND I LOOKED AT THESE TO MAKE SURE THAT WE'RE STILL COMPLIANT WITH ALL THE ORDERS THAT ARE OUT THERE.

UH, THE, UH, THE PARTS CONTINUED TO BE OPEN, UH, MASK AGAIN AT ONE TIME WERE REQUIRED.

THE GOVERNOR TOOK THAT ABILITY AWAY FROM, FROM CITIES.

IT IS HIGHLY RECOMMENDED THAT HE'D BE ENLISTED THE, THE, UH, THE JUDGE, UH, THE, THE GOVERNOR CHANGES THAT OR RE SENDS HIS ORDER.

SO, UH, I AM RECOMMENDED THAT THIS, UH, ORDER DISCIPLINE ORDER BE APPROVED FOR SIX MONTHS STARTING, UH, THIS EVENING AND TERMINATING ON JUNE 24TH, 2022.

THE, UH, FOR THE RECORD, MANNY DELAROSA, BEFORE YOU HAVE THE, UH, AN AGREEMENT WITH CAMERON COUNTY EMERGENCY SERVICES, DISTRICT NUMBER ONE, WHICH IS THE FIRE SERVICES CONTRACT, AS YOU MIGHT RECALL, UH, WE, THIS CONTRACT, UM, COMES BEFORE YOU ANNUALLY.

HE DID HAVE A CONVERSATION WITH THE ASSISTANT COUNTY ATTORNEY.

AND, UH, UM, I'M HAPPY TO SAY THAT MR. SAUCY AGAIN, PREVAILED, UH, AND THIS AGREEMENT NOW MEETS THE, UH,

UH, THE CITY'S BENEFIT.

IT CONTINUES TO PAY US, AND YOU'LL SEE THAT THERE'S SOME AMOUNTS IN HERE, UM, FOR THIS BUDGET YEAR, UH, WE'RE EXPECTING $278,989 AND 64 CENTS IN INSTALLMENT PAYMENTS, WHICH, UM, UH, THEY ARE PAYING FOR SERVICES THAT ARE BEING PROVIDED BY THE CITY, UH, FIRE PERSONNEL.

SO IT IS STAFF'S RECOMMENDATION THAT THIS, UH, AGREEMENT BE APPROVED.

OKAY, MR. DELAROSA, UH, WE SAW A MAP THE LAST TIME THIS WAS APPROVED.

THE MAP CHANGE.

AND I REMEMBER NINE CONSIDERATION POSSIBLE ACTION TO APPROVE A SERVICE AGREEMENT WITH, UH, THE SHOP FOR HISTORIC, UH, ROBERSON STREET MARKET DAYS EVENTS STARTING JANUARY 1ST, 2022, AND ENDING DECEMBER 31ST, 2022.

AND MR. CLEVELAND LAWYER PRESENT COMMISSIONERS, UH, FOR THE RECORD CODE COMPLIANCE DIVISION CONSIDERATION, AND POSSIBLE ACTION TO APPROVE AS A SERVICE AGREEMENT WITH THE SHOP WHERE THE HISTORIC ROBERTSON STREET MARKET DAY'S EVENT, STARTING JANUARY 1ST, 2020, 22, AND ENDING DECEMBER 31ST, 2022 CLEO.

DID ANYTHING CHANGE FROM THE LAST SERVICE AGREEMENT OTHER THAN THE INSURANCE SYSTEM ONLY THAT'S REALLY THE ONLY CHANGE.

AND THAT'S BASICALLY ON, ON, WE'RE PUTTING IT ON, ON MS. GARCIA THAT SHE HAS TO BE, UH, RESPONSIBLE FOR THE, FOR THAT COVERAGE COMMISSIONER, IF I CAN, UH, MAYBE HELP HERE, UH, SECTION FOR A CHANGED FROM WHATEVER.

I DON'T RECALL WHAT THE LAST AGREEMENT IS BECAUSE WE'VE HAD SEVERAL SERVICE AGREEMENTS THROUGHOUT OUR, UH, WITH OTHER ORGANIZATIONS.

SO, UM, BUT, UM, I THINK THIS IS THE MOST IMPORTANT THAT WE WANT IT TO MAKE SURE THAT WE WERE NOT COLLECTING A VENDOR FEE FROM ANY BUSINESS THAT ARE OPERATES WITHIN CITY LIMITS, WHETHER THEY HAVE A BRICK AND MORTAR LICENSE OR SOMETHING.

UH, I MEAN, THEY COULD HAVE A, IT COULD BE A FOOD VENDOR WAS REALLY, THEY HAVE THE VEHICLE, THE REGISTERED HOME HERE IN SAN BENITO, AND IT COULD BE THERE.

SO AS LONG AS THEY'RE A, A BUSINESS THAT PAYS PROPERTY TAXES TO US, OR IT'S REGISTERED HERE IN THE CITY AND PROVIDES THAT, THAT DOCUMENTATION, THERE'S NO, THERE'S NO FEES THAT WE COLLECT NOW, SHOULD VENDORS FROM THE OUTSIDE, COME IN SELLING FOOD OR SELLING ITEMS. WELL, YES, THEN THEY PAY, UH, WHAT'S ON OUR FEE SCHEDULE IN ACCORDANCE WITH OUR ORDINANCES.
